Welcome to Photoloft, LLC ("Photoloft", "we", "our", or "us"). By accessing or using our website (https://www.photoloft.co), booking our services, or utilizing our studio space, you ("user", "you", or "your") agree to be legally bound by these Terms of Service. If you do not agree with any of these terms, you must not use our services.
- Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use our services. If you are under 18 but at least 13, you may only use our services under the supervision of a parent or legal guardian who agrees to these Terms. - Booking and Payment
All bookings are subject to availability and confirmation. By making a reservation, you authorize Photoloft to charge your payment method on file for all fees associated with the booking, including but not limited to overtime, damages, cleaning, and rescheduling fees. You also consent to us storing your payment method for off-session charges through Stripe, our secure payment provider. - Use of Space
You agree to use the studio responsibly and in accordance with all applicable laws and our posted guidelines. You will be held responsible for the conduct of all guests, clients, or third parties you invite into the space. - Prohibited Use
You may not use the space for any illegal, abusive, or prohibited activities, including but not limited to adult content production, drug use, or unauthorized commercial activity. Photoloft reserves the right to cancel a session or refuse service at any time for violations. - Damages and Cleaning
You are responsible for any damage caused to the studio or its contents during your session. A minimum $100 cleaning fee may apply if the space is not returned in a satisfactory condition. All damage and cleaning fees will be automatically charged to the card on file. - Limitation of Liability
You agree that Photoloft shall not be liable for any injury, loss, or damage to persons or property related to your use of the space. You waive the right to bring any legal action against us for such claims and agree to indemnify us for any losses incurred as a result of your use. - Items Left Behind
Any personal belongings, props, or equipment left behind at the studio must be claimed within 48 hours of the end of your booking. If you contact us within that time, we’ll make reasonable arrangements for pickup. If no contact has been made within 48 hours, Photoloft reserves the right to dispose of or donate any unclaimed items at our discretion. Please note that Photoloft is not responsible for lost, damaged, or discarded items left behind after a session. - Termination and Account Suspension
We reserve the right to suspend or terminate access to our services for violations of these Terms without notice. All outstanding charges will be due immediately upon termination. - Amendments
Photoloft may update these Terms at any time. Your continued use of our services constitutes acceptance of the revised Terms. - Dispute Resolution
Any disputes shall be resolved in accordance with the laws of the State of Texas. Venue shall lie in the courts of Dallas County, Texas. You waive the right to trial by jury or to participate in class actions.

Photoloft uses Twilio (SMS) and SendGrid (email) to deliver service-related communications. These communications are necessary for the provision of our services and may not be opted out of unless your account is closed. These include but are not limited to:- Booking confirmations and modifications

- Promotional Messages
Users may voluntarily opt in to receive marketing or promotional content. You may unsubscribe at any time by clicking the unsubscribe link in an email or replying STOP to SMS. Additionally, you can contact us at support@photoloft.co to have us manually remove you. Members can also change their Account Preferences. - Communication Preferences
Communication settings can be managed through your reservation page or by contacting support@photoloft.co. We aim to honor preference updates within 48 hours. - Data Handling
All contact information is handled securely in compliance with our Privacy Policy and applicable data laws. Contact information is never sold or shared beyond essential service providers.

Membership Agreement

This Agreement governs membership access to Photoloft, LLC’s facilities and services. By enrolling in a membership, you agree to the terms outlined below.
- Membership Rules
Members must follow all posted rules, instructions, and staff directives. Members are responsible for guests' behavior and must be present at all times during their reservation. - Non-Transferability
Memberships and member rates are non-transferable. Booking for someone else is a serious violation and grounds for immediate termination. - Security Camera Use
Studio cameras are always on unless a member requests deactivation by providing proof of insurance and receives approval. Members are responsible for informing their guests of active surveillance. - Three-Strike Policy
Each violation of our rules counts as one strike. After three strikes, your membership will be revoked without refund. All previous discounts will be void, and you may owe the difference for past bookings. - Cancellation
You may cancel your membership at any time. No refunds will be issued for unused time or bookings. Memberships may be reinstated upon request and review. - Liability Waiver
You agree to release Photoloft, its staff, and property owners from any claims related to injury, loss, or damages incurred during use of our spaces. - Modifications
Photoloft may change these terms with notice. Continued use indicates acceptance.

Cancellations & Refunds

This policy outlines the conditions under which reservations may be canceled or rescheduled and any applicable refunds are issued
- Refund Structure
Users can cancel their reservations at any time. If cancelled, a refund may be issued in the for of account credits that are available to be used for future reservations. The refund total is dependent on the amount of notice Photoloft is given before the start of the reservation.
- Cancel more than 7 days in advance: 100% credit
- Cancel within 7 days: 50% credit
- Cancel same day: No credit issued
- No Cash Refunds
Cash refunds are not guaranteed. If account credit is not feasible, you may contact support@photoloft.co to request a review. Any cash refunds are discretionary and reviewed case-by-case. - Rescheduling
Each booking is allowed one reschedule only, subject to availability. Any future cancellation of a rescheduled booking will void eligibility for any credits or refunds. - Process
All cancellations or reschedule requests must be made via your reservation page or support@photoloft.co. Requests submitted via other channels may not be honored. - Force Majeure
Photoloft is not responsible for cancellations due to weather, transportation, or third-party failures. Credits or reschedules in these cases are discretionary.

Camera Monitoring

This policy describes Photoloft’s use of surveillance in our studios and how customers can submit a Privacy Request to disable the security cameras.
- Surveillance Scope
Our studios are equipped with security cameras to protect our property and users. Cameras are active during all sessions unless disabled under approved conditions. - Disclosure Requirement
It is the customer's responsibility to inform all guests, clients, and crew members that the studio may be monitored via security camera during the reservation. - Turning Off Cameras
Camera deactivation ("Privacy Requests") will be considered if proof of general liability insurance is provided by the guest. Privacy Requests must be submitted at the time of booking via the “Disable Cameras” action on the reservation page, or emailed to support@photoloft.co. Requests submitted within 24 hours of the start of the reservation may not be honored. - Limitations and Denial
Photoloft reserves the right to deny Privacy Requests for any reason, including but not limited to risk assessments, staff availability, or prior violations. While Photoloft strives to provide context when a request is denied, it is not obligated to offer an explanation. - Misrepresentation
Failure to disclose intent for high-risk activity or misrepresentation of insurance coverage may result in immediate cancellation and forfeiture of fees.
All disputes relating to monitoring are subject to our Terms of Service and local law.
