Membership Terms

Last Updated August 1, 2023

By becoming a member of Photo Loft ("Company"), you ("Member") accept the terms of this Membership Agreement.

  1. Rule Compliance: As a member, you pledge to abide by all rules established by the Company. You understand these rules may change periodically and it is your responsibility to stay informed about any updates.
  2. Space Respect: Members should respect the shared studio spaces and all equipment. Any damage caused by negligence or misuse may result in charges and/or penalties.
  3. Reporting Damages: Members are obliged to report any damages, spills, or stains immediately to the Company. Timely reporting allows for swift resolution before the arrival of the next booking.
  4. Check Out Process: You agree to adhere to every step of the Company's check out process, which may include taking out the trash if it's full. Any deviation from the established steps will be considered a violation of this agreement.
  5. Booking Policies: Members are solely permitted to book for their own use. Reservations made by members are strictly non-transferrable. Members cannot book a reservation and allow someone else to use the space without the member being present. Any violation of this rule is a serious infringement of this agreement and may result in immediate termination of the membership.
  6. Security Camera Policies: Members wishing to turn off our security cameras for increased privacy must select the "Turn Wifi Cameras Off" add-on option while scheduling their reservation. This is the only way for us to be aware of their preference. If this add-on is left off by mistake and the cameras are left on, the responsibility falls on the member and the Company will not be held liable for any privacy issues that may arise as a result. If a member forgets to select this option at the time of booking, or decides they want the cameras off after making the booking, they can notify us by emailing management@photoloft.co. Regardless of the status of the cameras, members must not leave the studio until they have contacted management. A representative will then turn the cameras back on (if they were turned off) and inspect the studio to ensure everything is in order.
  7. Two-Strike Policy: The Company enforces a two-strike policy for violations. Any rule infringement or deviation from the check out process counts as a strike. If you receive two strikes, the Company may revoke your membership without providing a refund. Additionally, you may be required to pay the difference in booking fees. For instance, if you booked a session at a discounted rate but are removed from the membership program for non-compliance, you will be required to pay the difference in price that a non-member would pay to book our studios.
  8. Membership Revocation: You understand that the Company operates a two-strike policy. Any violation of the rules or any missed step in the check out process will count as a strike. If you receive two strikes, the Company reserves the right to revoke your membership immediately.
  9. Membership Cancellation: Whether free or paid, memberships can be cancelled at any time without penalty. To do this, send a cancellation request via email. If you cancel your membership, you will no longer have access to member rates, perks, and activities. The company will not refund any payments or booking fees. However, it is possible to reactivate your membership if you have not received two strikes on your account due to non-compliance with our rules. In order to cancel your membership, you can simply notify us via email. We will process your request as soon as possible and ensure that your membership is cancelled promptly. Please note that once your membership is cancelled, you will no longer have access to membership rates, perks or be able to participate in any membership related activities. However, we would be happy to welcome you back as a member at any time in the future.
  10. Limitation of Liability: You understand that you are responsible for your own safety and the safety of your guests/clients while on the Company's property. The Company, its representatives, or landlord are not liable for any injury, loss, or damage to your personal property that you might incur while using the studios, performing check-out tasks, or during use of the space.
  11. Waiver of Rights to Sue: By participating in the membership program, you release the Company, its agents, representatives, employees, landlords of the properties, and any third parties acting on its behalf, from any claims, liabilities, demands, actions, costs, legal or otherwise, arising out of injury, illness, damage, or loss.

By signing up to become a member, you acknowledge that you have read, understood, and agreed to the terms set forth in this agreement.
